Access to and use of the website www.featherandfern.co.uk (the "Website") and the products and services available through the Website (the "Services") is subject to the following terms (the "Terms of Use"). By accessing the Website, you are hereby agreeing to all of the Terms of Use as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service. If you do not agree with any of our Terms of Use you should not use the Website.
These Terms of Use govern the relationship between you and Feather and Fern Limited when you access the Website. Any reference to "you" or "your" means you as a user of the Website. Any reference to "us" or " Feather and Fern " is to Feather and Fern Limited

By using this Website, you consent to the terms of our Privacy Policy which can be found below in our: Privacy Policy. We recommend that you read these. They govern our use of all personal data submitted by you. Feather and Fern does not store debit or credit card details when payments are made using the Website or the Services.
3. Restrictions
You agree that you will not use the Services in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person.
You will not do anything that may cause damage to the Services or our servers, systems or equipment or those of third parties, nor access or attempt to access any users' data or to penetrate or attempt to penetrate the Website security measures.
You agree to compensate us in respect of any damages suffered by us or any of our losses resulting from any claim made by a third party in each case in respect of any matter arising from your use of the Services in breach of these Terms of Use or from your violation of any applicable law or regulation.
You agree not to give any indication that you have any commercial relationship with us, or that you are our agent or that we have endorsed any submission you may make.
We reserve the right to suspend, restrict or terminate your access to any, or all, Services at any time at our sole discretion.
We may also ban or suspend you as a user of the Services if you do not comply with these Terms of Use.

All intellectual property rights in this Website and all material or content made available by us via the Services shall remain at all times the property of Feather and Fern or Feather and Fern's licensors.
The names, images and logos identifying us, our partners or third parties and our/their products and services contained in the Services are proprietary marks and may not be reproduced or otherwise used without express permission.
Nothing contained in these Terms of Use shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright of Feather and Fern or of any third party.
The contents of the Services, web pages, computer codes of elements comprising the Website and any software provided to you by us may not be copied, reproduced, communicated and/or made available to the public, republished, downloaded, posted, recorded, broadcast or transmitted or used in any other way except for your own personal, private and non-commercial use, or unless otherwise expressly permitted by us.
5. Delivery Policy
By placing an order you are offering to purchase a product on and subject to these Terms of Use. All orders are limited to the UK and subject to availability and confirmation of the order price.
We aim to deliver products, using Royal Mail, within 2-5 business days when products are in stock. However, dispatch times may vary according to availability and are subject to any delays resulting from postal delays or acts of god, for which we will not be responsible.
In order to contract with Feather and Fern you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Feather and Fern retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
All prices are inclusive of VAT. Delivery costs of £**** per item will be charged in addition; such additional charges are clearly displayed.
6. Returns Policy
For a "goodwill" refund or exchange after you have received goods, you can return any item to us for a refund or exchange within 14 days. Provided that you have proof of purchase and items are returned in their original packaging and in re-saleable condition we will exchange or refund the cost of the products within 30 days of receipt. Toiletries and ear-rings are non-returnable and non-exchangeable. Where goods are returned because they are damaged or not of satisfactory quality then we will reimburse you for the cost of sending the item back to us. Otherwise, for "goodwill" refunds or exchanges we do not reimburse these costs.
7. Cancellation Policy
Our "goodwill" returns policy above does not affect your legal rights under the Consumer Protection (Distance Selling Regulations) 2000 (the "Regulations"). Under the Regulations UK customers have the legal right to cancel their order up to the end of seven days after the day on which the goods were received. If you would like to cancel your order under the Regulations please email us using the details set out under Contact Details below. We will refund the costs of the goods (but not the delivery costs) within 30 days of receiving your cancellation.
8. Limitation of liability
All Services on the Website are provided on an 'as is' and 'as available' basis. We do not guarantee which Services will be on the Website. We cannot promise that our Services will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. The Services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control. We will not be liable to you or to any other person in the event that all or any part of the Services is discontinued, modified or changed in any way.
We do not accept any liability for:
(a) any damage or loss caused to you where you are not entering into these Terms of Use as a consumer;
(b) any damage to your computer, any software or for any loss of data that results from your use of the Services;
(c) any claims brought against you by a third party except as stated in these Terms of Use.
Nothing in these Terms of Use will:
(d) restrict your statutory rights as a consumer (including your rights to receive a reasonable standard of service, more details about which can be obtained from your local Trading Standards Office or Citizen's Advice Bureau);
(e) limit our liability for death or personal injury resulting from our negligence or for fraud.
These Terms of Use shall not make us responsible for any damage or loss caused to you where such damage or loss is not reasonably foreseeable to you and us when you use the Services, including where the damage or loss results from our breach of these Terms of Use.
9. Linking to this website
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you.
This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.
10. Indemnity
You agree to indemnify, defend and hold harmless Feather and Fern, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.

Feather and Fern shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.
12. Invalidity
If any part of the Terms of Use is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Use will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
13. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
14. Governing law and jurisdiction
These terms and conditions are governed by the laws of England and the parties agree to the exclusive jurisdiction of the English courts.
15. Entire agreement
The above Terms of Use constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Feather and Fern. Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by a Director of Feather and Fern.
